Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of PanoraCast (the "Service"), a cloud-based IP camera streaming platform operated by Nori Systems GmbH ("we," "us," or "our"), a company registered in Switzerland.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

PanoraCast is a cloud-based IP camera streaming platform that enables users to connect IP cameras via RTSP or RTMP protocols, stream live video via HLS (HTTP Live Streaming), and embed streams on websites. The Service includes the following features:

  • Real-time camera streaming with automatic reconnection
  • Periodic snapshot generation from live streams
  • Time-lapse video creation
  • Stream analytics and viewer statistics
  • Embeddable HLS player with customization options
  • Access controls including PIN protection, domain restrictions, and scheduling
  • Camera management dashboard

HLS streaming technology typically introduces a latency of 3 to 5 seconds between the camera source and viewer playback. This is inherent to the HLS protocol and does not constitute a defect in the Service.

3. Account Registration

To use the Service, you must create an account. You agree to the following:

  • You must be at least 18 years of age to create an account.
  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You may register using email and password or Google OAuth.
  • One account per person. Multiple accounts may be terminated without notice.

You must notify us immediately at [email protected] if you suspect unauthorized use of your account.

4. Subscription Plans and Billing

PanoraCast offers the following subscription plans:

  • Free Plan: 1 camera with basic streaming features
  • Standard Plan: $18 per camera per month, includes embedding, recording, and CDN delivery
  • Pro Plan: $28 per camera per month, includes audio streaming, time-lapse generation, domain restrictions, and scheduling controls

All paid subscriptions are billed monthly via Stripe. You may cancel your subscription at any time through the dashboard at https://app.panoracast.com. Cancellations take effect at the end of the current billing period.

Refund Policy: We do not provide refunds for partial billing periods. If the Service experiences downtime exceeding 24 consecutive hours due to our infrastructure failure, we will apply a prorated credit to your account for the affected period.

We reserve the right to modify pricing with 30 days' notice to active subscribers. Price changes do not affect existing subscriptions until renewal.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. Specifically, you agree not to:

  • Stream content that is illegal, defamatory, obscene, or violates third-party rights
  • Stream from cameras you do not own or have authorization to operate
  • Conduct illegal surveillance or violate privacy laws of any jurisdiction
  • Stream content containing hate speech, violence, or adult/explicit material
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Launch denial-of-service attacks or otherwise abuse the platform infrastructure
  • Use automated tools to scrape or harvest data from the Service without permission
  • Resell or redistribute the Service without a written agreement

You are solely responsible for ensuring your camera streams comply with all applicable laws, including privacy and surveillance regulations in your jurisdiction. Where required by law, you must obtain consent from individuals before streaming.

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice and without refund.

6. Intellectual Property

The PanoraCast platform, including its software, design, trademarks, and documentation, is owned by Nori Systems GmbH and protected by copyright, trademark, and other intellectual property laws.

You retain all rights to the camera content you stream through the Service. By using the Service, you grant us a limited, non-exclusive license to process, store, transmit, and deliver your streams to viewers you authorize. This license terminates when you delete your content or close your account.

7. Privacy and Data

Our collection and use of personal data is governed by our Privacy Policy, available at https://panoracast.com/privacy. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Service Availability and SLA

We strive to maintain high availability of the Service but do not guarantee 100% uptime. Factors beyond our control, including internet connectivity, camera hardware failures, and third-party services, may affect availability.

Scheduled maintenance windows may occur with advance notice. We provide automatic reconnection for camera streams, but you are responsible for ensuring your cameras remain powered, connected, and properly configured.

The Service is provided "as is" without warranty of any kind. We do not guarantee uninterrupted, error-free, or secure operation.

9. Limitation of Liability

To the maximum extent permitted by law, Nori Systems GmbH shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to:

  • Loss of data, revenue, or profits
  • Business interruption or lost opportunities
  • Unauthorized access to your streams or account
  • Errors, viruses, or malicious code transmitted through the Service

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the total fees you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nori Systems GmbH, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your camera content or streams
  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy or intellectual property rights

11. Termination

Either party may terminate these Terms at any time. You may close your account through the dashboard or by contacting support. We may suspend or terminate your account immediately if you violate these Terms.

Upon termination, your access to the Service will cease, and your data will be deleted within 30 days. Camera streams, snapshots, time-lapses, and account settings will be permanently removed and cannot be recovered.

Provisions of these Terms that by their nature should survive termination (including liability limitations, indemnification, and governing law) shall remain in effect.

12. Changes to Terms

We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email to the address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and may close your account.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of Switzerland.

14. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nori Systems GmbH regarding the Service and supersede all prior agreements.
